Club Cash Program Terms

These Club Club Cash Program Terms (these “Program Terms”) are between you and Truckparkingclub.com, LLC (“we,” “us,” or “our”). These Program Terms describe the terms and conditions that apply to your participation in the Club Cash Program (the “Program”) on our website at truckparkingclub.com including any content, functionality, and services offered on or through truckparkingclub.com, hosted applications, mobile or other downloadable applications, and other services provided by us (the “Service”) and are by this reference hereby incorporated into and subject to our Terms of Use (available here: https://truckparkingclub.com/terms-of-service) (“Terms of Use”) including the Wallet Terms and Conditions (available here: https://truckparkingclub.com/wallet-terms) (“Wallet Terms”). These Program Terms do not alter in any way the terms or conditions of any other agreement you may have with us. Capitalized but undefined terms used in these Program Terms have the meanings given to them under the Terms of Use or Wallet Terms, respectively.

BY REGISTERING ON THE SERVICE, YOU WILL BE AUTOMATICALLY ENROLLED INTO THE PROGRAM. BY PARTICIPATING IN THE PROGRAM OR AGREEING TO THE TERMS OF USE, YOU AGREE THAT YOU HAVE READ AND UNDERSTOOD, AND, AS A CONDITION TO YOUR PARTICIPATION IN THE PROGRAM, YOU AGREE TO BE BOUND BY, THESE PROGRAM TERMS.

The Program is provided in our sole discretion, and we may change or terminate the Program at any time.

1. HOW TO JOIN

Program Overview. The Program is a rewards program where eligible Service members (see below for full eligibility details) may earn rewards in the form of balances in a certain amount added by us to a TM Wallet (“Bonus Club Cash”) in connection with certain activities that we may determine from time to time. Bonus Club Cash are balances in a TM Wallet subject to the Wallet Terms and Conditions.

Signing Up. You will be automatically enrolled in the Program when you register for an Account (as defined in the Terms of Use) on the Service. No purchase is necessary to join the Program. This Program is for Truck Parking Club only, and signing up for or participating in this Program will not give you any rights or benefit in any other program.

Eligibility. The Program is part of our services, and all applicable terms (including eligibility rules) in the Terms of Use will apply to your participation of the Program. In addition, to participate in the Program, you agree that: (1) the Program is for individual Truck Parking Club members with a truck member (“TM”) Wallet; and (2) you hold only one TM Wallet on your own behalf and you may only participate in the Program with that TM Wallet. If you are not eligible, you may not participate in the Program. If you become ineligible after you have joined the Program, we reserve the right to immediately terminate your participation (including any Bonus Club Cash associated with your Account and TM Wallet).

1. HOW TO EARN BONUS CLUB CASH

Earning Activities. Details on how a TM may be able to earn Bonus Club Cash (“Earning Activity”) are listed within these terms. We may also announce other Earning Activities (which may be limited-time) via social media or email, in which case, the terms in those announcements will apply to the applicable Earning Activity and are incorporated into these Program Terms by this reference. The availability of Bonus Club Cash assigned to each available Earning Activity may be updated in our sole discretion from time to time and will be effective upon publication via the Service or other communication from us to you. If we credit Bonus Club Cash to your TM Wallet for achieving an Earning Activity, and a subsequent event causes you to not meet the requirements of the Earning Activity, we reserve the right and discretion to deduct the amount of any Bonus Club Cash corresponding to that Earning Activity from your TM Wallet balance.

Earn from your Usage. TM is eligible to receive Bonus Club Cash when funding a TM Wallet via ACH and through other usage of the TM Wallet in accordance with our applicable policies, as updated from time to time at https://truckparkingclub.com/club-cash-terms. We may also have promotional offers where we offer Bonus Club Cash for certain qualifying activities or certain customers from time to time. We may deduct the amount of any Bonus Club Cash from your TM Wallet balance corresponding to any refund of money that you load to the balance of your TM Wallet.

Bonus Club Cash obtained via the Program is provided to you under a limited, personal, revocable, non-transferable, non-sublicenseable license.

We reserve the right to cancel, restrict or terminate the Program at any time for any reason. Any Bonus Club Cash we choose to provide to you under the Program are discretionary, MAY EXPIRE, and are NOT CASH. Bonus Club Cash is not your property, has no cash value, and cannot be transferred during or after your life, by operation of law or otherwise.

Expiration. Unused Bonus Club Cash balance in your TM Wallet will expire after 365 days of inactivity, that is, if you haven’t earned or redeemed any Bonus Club Cash in a year. Your Bonus Club Cash balance will also expire upon the termination of your participation in the Program (e.g., if you are no longer eligible), termination of these Program Terms or the Terms of Use, or termination of your Account or TM Wallet.

Modification; Termination. WE RESERVE THE RIGHT TO MODIFY THESE PROGRAM TERMS AT ANY TIME, including to add or remove Program benefits. Any modification will be effective upon the earlier of your acceptance of it or its publication. We may terminate your participation in the Program at any time, including if we determine that you are not eligible or if we believe that you are associated with any fraudulent or unauthorized activity, including the use of any Bonus Club Cash.

Limitation of Our Liability. You agree that under no circumstances are we liable to you for any damages or claims that may arise from the loss or use of your Bonus Club Cash. You absolve us of any responsibility to maintain or update the balance in your TM Wallet. However, if there is a loss of Bonus Club Cash in your Account due to our technical or operational problems with the Program, we may refund the lost Bonus Club Cash once the loss and cause have been verified. Without limiting any of the foregoing, our maximum liability or responsibility to you is to refund the Bonus Club Cash lost. This limitation of liability in these Program terms in no way limits any other limitation of liability in the Terms of Use or Wallet Terms.
